Terms & Conditions


  1. Introduction

    Silveray Stationery Company (promoter, we, or us) ) is running a promotional competition. Purchase any Parker Pen from participating stores, follow the entry steps for a chance to win a trip to London valued at R50 000 

  2. Definitions
    In this Agreement
    1. participant or you means the person who purchases a Parker Pen and follows the entry steps.
    2. promoter means Silveray Stationery Company or its agencies used to promote this competition.
    3. website means www.parkerpensa.co.za.
     
  3. Duration
    1. The competition will run from 1 November 2018 to 23:59 on 28 February 2019 and the draw will take place during March 2019 at our head office.
     
  4. Participation
    1. The competition is conducted by the promoter and its third party contractors.
    2. No one who is a director, employee or agent of or consultant to us or who is a spouse, life partner, close family member (parents, children, brothers and sisters), business partner, or associate to a director, employee or agent of or consultant to us may take part or enter the competition.
    3. This competition is open to legal residents of the following countries: South Africa, Botswana, Lesotho, Malawi, Namibia, Zambia, Zimbabwe and Swaziland aged 18 years or over.
    4. You must have a valid delivery address within your country and Identity Document when claiming a prize.
    5. Entry into this competition is regarded as acceptance of these terms and conditions.
    6. Any entries received before or after the competition period are invalid and will not be considered.

  6. How to enter
    1. In South Africa:
      To enter you must purchase any Parker Pen (excluding refills) and SMS your name and the last 6 digits of the barcode to 33491. You will receive an SMS to confirm your entry and a link to go upload your till slip onto the website.
           • You must keep your till slip as proof of purchase.
           • The SMS entry costs R1.50 and free SMSes do not apply.
           • You will receive a reply SMS confirming your entry.
       
    2. In Botswana, Lesotho, Namibia, Swaziland, Malawi, Zambia and Zimbabwe:
      To enter you must purchase any Parker Pen (excluding refills) and enter via the website at www.parkerpensa.co.za and provide the following information:
            • cell phone number
            • name,
            • last 6 digits of the barcode; and
            • upload a copy of your till slip.
       
    3. Multiple entries.   You may enter more than once provided that each entry is accompanied by a unique till slip. If you want to enter more than once you must upload a copy of your till slip. This is for entries for all countries.

    5. You may only win one prize.
    6. Consumer Protection Act.    Under the Consumer Protection Act (CPA), we need to keep records of all the people used to promote the Promotional Competition. We (or one of our subcontractors or affiliates) will keep this agreement for three years to serve as the record as required by the CPA.
    7. We are not liable for any technical failure that may result in an entry not being successfully submitted.
    8. If you don’t upload a copy of your till slip you will have to provide the till slip as proof of purchase – dated before or on the day of the entry in order to receive the prize.
    9. If you do not complete all the entry requirements you will not be eligible to receive the prize.

  7. Promotional competition reward
    1. Prize. The winner will win a travel voucher valued at R50 000 to book their trip to London and must be booked by the promoter’s selected travel agency
    2. Redeeming prizes. We will select and contact the prize winner within three weeks of the close of the competition. We will arrange to award the prizes with the prize winners within a reasonable time.
    3. Limitation to using your prize. Certain conditions may apply to redeeming your prize. We will not be responsible for any loss or damage caused by you not being able to use the prize at a time that is convenient for you.
    4. It is your responsibility to make your own way to the city of departure at your own expense. This includes entrants from qualifying countries outside of South Africa that enter the competition.
    5. Flights depart from the following cities for travel to London:
      • Cape Town (South Africa) and
      • Johannesburg (South Africa).

    7. The flights are non-direct and booked in economy class.
    8. Peak season block-out periods may apply.
    9. You are responsible for your own spending money and meals.
    10. You may need to obtain a Visa; these costs (approximately R1500 per person) are for your own account.
    11. You must be in possession of a valid passport and it must be valid for at least six months after your return date.
    12. You must obtain travel insurance
    13. All children (under the age of 18) require an unabridged birth certificate when departing or entering South Africa. If you are travelling with a minor please consult an agent about any additional requirements.
    14. You must book your trip within six months of the date of reward and all travel must be completed before 31 March 2020.
    15. If the offer is not taken up by the expiry date of 31 March 2020, the offer will be forfeited and the promoters shall have no obligation to refund any monies in lieu of these un-utilised flights nor to extend the offer.
    16. Once the booking is confirmed, any changes to the time and date of travel prior to departure and all costs and administration fees will be covered by the winner and not by the promoters.
  8. Prize winner selection and publicity
    1. Choosing a winner. The prize winners will be randomly drawn by the promoter after the end of the competition. All entrants will be included in the draw this will include the entrants from South Africa and other participating countries. Entrants will be merged and the ten winners will be selected randomly.
    2. How will you know if you have won. Each winner will be contacted telephonically after they have been selected. We will attempt to contact winners three times during a 72 hour period. If we cannot contact the winner during this period we will draw another winner. Winners who have not given the promoters the correct details will forfeit the prize.
    3. We may ask winners to take part in publicity connected to this competition. Winners grant permission for us to use their names and photographs in any advertising and promotional material for this competition. You may ask us to remove your name or refuse to take part in any publicity.
    4. Winners' names will be published on our website and on our social media pages.
    5. You will not receive any payment for taking part in the competition, or taking part in any media format related to it.
    6. You will need to provide us with a copy of your ID or passport to prove you are the prize winner.
    7. The prizes are not transferable. You cannot ask us to give you another prize of similar value or to pay out the value of the prize. We may substitute any prize with another prize of similar value.
    8. If you have won a prize from us within the last two years you are not eligible to win.

  9. Dispute resolution
    1. Arbitration. If there is any dispute, the parties must refer the dispute within 15 business days to arbitration (including any appeal against the arbitrator’s decision) under AFSA’s latest rules for expedited arbitrations.
    2. CPA dispute resolution. Despite 8.1, any party may use other dispute resolution channels provided for by the CPA or other law.
    3. Severability. This clause is separate and divisible from the rest of this agreement and stays effective even if this agreement ends or is invalid.

  11. General Rules
    1. No liability. By taking part in this competition you agree that you will not hold us liable for any losses, harm, damages, injury, claims or actions related to this competition.
    2. Force majeure. No party will be responsible for any breach of this agreement caused by circumstances beyond its control.
    3. Changing the rules. These rules, including the duration of the competition, can only be reasonably changed (or superseded) by us in a written revision to these rules posted on the competition website or any other potential official competition communication methods we use to reach a majority of potential participants.
    4. Tax. Income or other taxes relating to the prizes, if any, are the sole responsibility of the prize winner.
    5. Governing laws. The following laws govern this competition:

            • Lesotho,
            • Malawi,
            • Namibia,
            • Zambia,
            • Zimbabwe,
            • Swaziland; and
            • South Africa.
       
    7. Use of personal information. Participants understand and agree that in order to offer the competition, the promoter must collect and use personal information about them.
    8. Termination of the competition. If we need to, because of legislative or regulatory reasons, we may terminate the competition immediately and without notice. If this happens you will not have any claim against us, because of this.
